This Privacy Statement sets forth the online data collection and usage policies and practices that apply to the Veryable Service and associated websites or Apps (sometimes referred to herein as the “Veryable Service”) and does not apply to information we collect in any other fashion.

1.  Collection of Information by Veryable

When you access our Site or use WFM, we collect and store certain information about you, including Personal Data. Personal Data is information that, alone or in combination with other information in our possession, could be used to personally identify you. We collect the following categories of Personal Data and other information as described below.

2. INFORMATION YOU PROVIDE DIRECTLY

We may collect or receive the following categories of Personal Data when you create an account, verify your identity, use WFM or otherwise communicate with us:

  • Identifiers, such as name, email address, mailing address, and phone number.
  • Login credentials, including credentials for your Veryable account.
  • Financial information, such as bank account information and information relating to tax forms, such as Form W-9 and Form 1099-NEC.
  • Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), such as Social Security number, driver’s license, passport number, and state identification card number.
  • Protected classification characteristics under California or federal law, such as age, national origin, or citizenship.
  • Professional or work-related information, such as names of Customers for whom a Worker has performed work.
  • Audio or visual information, such as photos of your government-issued identification card.
  • Other information you voluntarily provide, such as information you provide through support or feedback channels or when you otherwise communicate with us.

3. INFORMATION WE COLLECT FROM THIRD PARTIES

We may collect and receive information about you, including Personal Data, from third parties, such as Customers, Customers’ service providers, and our own service providers, including for identity verification, fraud protection, providing the Services, and other purposes.

If you elect to use integrated Third Party Services, we may also have access to your Personal Data through such Third Party Services.

4. INFORMATION COLLECTED AUTOMATICALLY

We may also automatically collect, generate, and/or receive Personal Data from the Site or Services as follows:

  • Your employee's information, such as names, schedules, or hours worked (clock in/clock out).
  • Building production numbers, such as orders received, orders shipped, or units produced per employee.
  • Online identifiers, such as device identifier, operating system, browser type, and IP address,
  • Internet or other electronic network activity information, such as metadata, log data, web beacons, cookies, and similar technologies. We use both session cookies (which are deleted once you close your browser) and persistent cookies (which remain on your computer or device until you delete them or they expire).
  • Third-party analytics tools, which allow us to collect and analyze information about use of WFM. 

5. HOW WE USE YOUR INFORMATION

We use the information we collect from you for the following purposes: To provide, market, and improve WFM. For example, we may use your Personal Data in the following ways:

  • To personalize and improve your user experience and the overall quality of WFM, for example, by integrating your work schedule into your device’s calendar or validating the location you clock in from;
  • Process information you provide via your account registration with WFM, including verifying that your email address is active and valid;
  • Communicate with you about our products and services (including marketing messages and phone calls and transactional messages regarding your use of our Platform (such as providing shift schedules, letting you know about upcoming changes or improvements, responding to you when you contact us, or other administrative communications, including, in our discretion, changes to our Privacy Policy, Terms of Use, or any of our other terms or policies);
  • To protect Veryable, our Platform, and our users, including errors, misuse of the Platform, fraud, or any criminal activity and to detect and troubleshoot problems, resolve disputes, and enforce applicable agreements and policies for the Platform;
  • For internal business purposes, such as to improve WFM.

6. DISCLOSURE OF PERSONAL INFORMATION TO OTHERS

We do not disclose your personal information to third parties, or your combined personal and demographic information or information about your use of WFM except as follows: We may disclose information to third parties that provide services on our behalf, including hosting our Web servers, analyzing data, and providing customer service. These companies and individuals may have access to your personal information as necessary to perform their functions and can share such information in accordance with their privacy policies authorized service providers.

We may share your personal data with service providers that are authorized by us and perform services on our behalf, including customer support, web hosting, information technology, fraud control, direct mail, email distribution, events, contest, sweepstakes and promotion administration, marketing, and analytics services. We may also share personal data that is aggregated or de-identified information with authorized third parties for legitimate business purposes. 

We will not share any company specific information as it relates to product information, part numbers, labor usage, and similar information.  Business information will be depicted through the Platform exactly as input from the business for public consumption.

We will share personal information with companies, organizations or individuals outside of Veryable if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to (1) meet any applicable law, regulation, legal process or enforceable governmental request; (2) enforce applicable Terms of Service, including investigation of potential violations (3) detect, prevent, or otherwise address fraud, security or technical issues (4) Protect against harm to the rights, property or safety of Veryable, our users or the public as required or permitted by law.

7. USE OF COOKIES AND LOCAL STORAGE

WFM may contain electronic images known as Web beacons (sometimes called single-pixel gifs) that allow us to count users who have visited those pages. Web beacons are not used to access your personally identifiable information; they are a technique we use to compile aggregated statistics about our Web site usage. Web beacons collect only a limited set of information including a cookie number, time and date of a page view, and a description of the page on which the Web beacon resides. You may not decline web beacons, however, they can be rendered ineffective by declining all cookies or modifying your browser setting to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis. Third parties are not permitted to use Web beacons on WFM. We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches.

8. ACCESS TO, OPT-OUT AND/OR MODIFICATION OF YOUR INFORMATION

Veryable may provide account holders limited access to or the ability to modify your personal information. Whenever you use WFM, we aim to provide you with access to your personal information. If that information is wrong, we strive to give you ways to update it quickly or to delete it – unless we have to keep that information for legitimate business or legal purposes. When updating your personal information, we may ask you to verify your identity before we can act on your request.

Deactivate your account and data deletion. You may deactivate your account and request data deletion by sending us a message at support@veryableops.com. While your account is deactivated, you will not be able to use WFM. If at any point you want to reactivate your account, just contact us at support@veryableops.com.

Although we would like to keep all Users of WFM, sometimes users choose to stop using WFM. Therefore, we may retain indefinitely some or all the information we gather about you in an effort to make your repeat use of WFM more efficient, practical, and relevant.

9. SECURITY OF THE PERSONAL INFORMATION

We have implemented commercially reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes. We may offer you a multi-step verification when you access your Veryable Account. We restrict access to your personal information to Veryable employees, contractors and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.

CHILDREN- WFM is not intended for children under 18 years of age. We do not knowingly collect personal information from children under 18.

CONTACTS, NOTICES, AND REVISIONS- If you have any concerns about privacy at Veryable, please contact us with a thorough description, and we will try to resolve the issue for you.

If we decide to materially change our Privacy Policy for WFM, we will post those changes through a prominent notice on the website so that you will always know what information we gather, how we might use that information, and to whom we will disclose it. 10. ADDITIONAL INFORMATION FOR CALIFORNIA and CERTAIN US STATES

Your Rights. Under the laws of the states of California, Colorado, Connecticut, Utah and Virginia ("Applicable States"), you may have rights to ask us to:

  • provide access to certain information we hold about you, in some cases in a portable format, if technically feasible;
  • update or correct your information;
  • delete certain information we hold about you; and
  • opt in to or opt out of use of certain sensitive information we hold about you.

Authorized agents: You may also have the right to designate an authorized agent to help you exercise these consumer rights. To ensure the security of your Veryable account, we will generally ask you to verify your, or your authorized agent’s, request using the contact information you have already provided.

Exercising your rights: If you would like to exercise any of these rights, or appeal a decision made relating to your rights, please contact us at privacy@veryable.net. 

No sale of personal information. In the preceding twelve months, we have not sold any personal information of consumers, as those terms are defined under the laws of California or other Applicable States.

No discrimination. We will not discriminate against any consumer for exercising their rights under the privacy laws of California or other Applicable States.

California. Below are the additional disclosures required by the California Consumer Privacy Act and the California Privacy Rights Act (together, the "CCPA"), effective as of January 1, 2023.

Categories of personal information collected. The personal information that we may collect, or may have collected from consumers in the preceding twelve months, fall into the following categories established by the CCPA, depending on how you engage with us:

  • Identifiers, such as your name, email, address, phone numbers, or IP address;
  • personal information as described in subdivision (e) of Section 1798.80 of the California Civil Code, such as a credit card number;
  • characteristics of protected classifications under California or US federal law, such as age or gender, for example if we conduct user surveys or analysis;
  • commercial information, such as purchase activity;
  • Internet or other electronic network activity information, including content interaction information, such as content downloads, streams, and playback details;
  • geolocation data, such as the location of your device or computer determined from your IP address or mobile device’s GPS depending on your device settings;
  • audio, visual, electronic or other similar information, including when you communicate with us by phone or otherwise;
  • professional or employment-related information, for example data you may provide about your business; and
  • inference data, such as information about your preferences.

Categories of personal information disclosed for a business purpose. The personal information that we may have disclosed about consumers for a business purpose in the preceding twelve months fall into the following categories established by the CCPA, depending on how you engage with us:

  • Identifiers, such as your name, email, address, phone numbers, or IP address;
  • personal information as described in subdivision (e) of Section 1798.80 of the California Civil Code, such as a credit card number;
  • characteristics of protected classifications under California or US federal law, such as age or gender, for example if we conduct user surveys or analysis;
  • commercial information, such as purchase activity;
  • Internet or other electronic network activity information, including content interaction information, such as content downloads, streams, and playback details;
  • geolocation data, such as the location of your device or computer, for example if you enable location services to enhance your experience through applications we offer;
  • audio, visual, electronic or other similar information, including when you communicate with us by phone or otherwise;
  • professional or employment-related information, for example data you may provide about your business;
  • inference data, such as information about your preferences.

Sensitive personal information. The categories of data that Veryable collects and discloses for a business purpose include "sensitive personal information" as defined under the CCPA. Veryable does not use or disclose sensitive personal information for any purpose not expressly permitted by the CCPA.

11. ADDITIONAL INFORMATION FOR CERTAIN REGIONS

Australia

Laws authorizing or requiring collection of personal information. We may collect your personal information as permitted or required by applicable law, including where relevant the Privacy Act 1988 (Cth) and for customers, to create and retain records to satisfy our obligations under the Corporations Act 2001 (Cth).

Complaints. If you are not satisfied with the way we handle a complaint, you can submit a complaint to the Office of the Australian Information Commissioner at http://www.oaic.gov.au/privacy/privacy-complaints.

Canada

Your Rights. Subject to applicable law, you have the right to:

  • ask whether we hold personal information about you and request copies of such personal information and information about how it is processed;
  • request that inaccurate personal information is corrected;
  • request deletion of personal information that is no longer necessary for the purposes underlying the processing, processed based on withdrawn consent, or processed in non-compliance with applicable legal requirements; and
  • lodge a complaint with us regarding our practices related to your personal information.

European Economic Area and UK

Processor of Personal Information. Veryable, 2019 N. Lamar St, Suite 250, Dallas, Texas 75056 is the data processor for the personal information covered by this Privacy Notice.

Processing. The EEA and UK data protection laws require a legal basis for our use of personal information. Our basis varies depending on the specific purpose for which we use personal information. We use personal data for the following legal bases:

  • Performance of a contract when we provide you with our Services, or communicate with you about them. This includes when we use your personal information to process your order, administer your account, provide you with support, and process payments.
  • Our legitimate business interests and the interests of our customers when we improve our Services, when we detect and prevent fraud and abuse in order to protect the security of our customers, ourselves, or others, and when we advertise or market to you.
  • Your consent when we ask for your consent to process your personal information for a specific purpose that we communicate to you. When you consent to our processing your personal information for a specified purpose, you may withdraw your consent at any time and we will stop processing of your data for that purpose.
  • Compliance with a legal obligation when we use your personal information to comply with laws.
  • These and other legal bases depending on the purpose for which we use personal information.

Your Rights. Subject to applicable law, you have the right to:

  • ask whether we hold personal information about you and request copies of such personal information and information about how it is processed;
  • request that inaccurate personal information is corrected;
  • request deletion of personal information;
  • request us to restrict the processing of personal information where the processing is inappropriate;
  • object to the processing of personal information;
  • request portability of personal information that you have provided to us (which does not include information derived from the collected information), where the processing of such personal information is based on consent or a contract with you and is carried out by automated means;
  • if we have collected and processed your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent; and

Transfers outside of the EEA/UK. We may transfer personal information from the EEA and UK to other countries that may not have the same level of data protection that applies in your jurisdiction. In these cases, we use a variety of legal mechanisms to ensure that the recipient of your personal information offers an adequate level of protection, including entering into the standard contractual clauses for the transfer of European data approved by the European Commission, or where required, we will ask you for your prior consent.
